The National Labor Board (NLB) was created in August 1933 to function as a mediation board, seeking to persuade the parties to settle their differences peacefully. It was composed of seven members; three representatives each would be chosen by the NRA's Industrial Advisory Board and Labor Advisory Board. The weakness of enforcement powers given to the NLB was its most serious drawback. NLB established the principles of majority rule and exclusive representation of the employees in a particular bargaining unit in addition to which the Board developed other rules that have come to be basic principles of labor relations law such as:
an employer was obligated to bargain with a union that had been chosen as representative by a majority of employees;
employers had no right to know of an employee's membership in, or vote for, a union when a secret ballot representation election was held; and
strikers remained employees while on strike and were entitled to displace any replacements hired if the strike was the result of employer violations of the NIRA.
