In general, agreements to arbitrate ADEA claims will be enforced when they were voluntarily and knowingly agreed to by the employees, but such arbitration agreements do not prevent the EEOC from bringing a suit on behalf of the individual employees subject to the arbitration agreements. The employees covered by a collective agreement that contained an arbitration clause that specifically included age discrimination claims were required to arbitrate their ADEA claims rather than litigate them.
