Use reliable sources to
determine what the policies and laws are in your own state. If your state has not
stipulated a policy, look elsewhere in your region to identify surrogate motherhood laws.
Do you believe they strike an appropriate balance among the competing interests in
these situations?

Answer to Question 2

Although Mr. Stern was granted custody (especially as he was the biological father),
Mrs. Whitehead was given visitation rights. If the right to have children is important, is it
less important than the rights of the child in determining custody? How should the best
interests of the child be determined in these situations?
