For a nurse to be charged with malpractice in a malpractice lawsuit, four legal elements must be present. Three of these are the duty the nurse owes to the client, a breach of that duty, and the breach of duty being the cause of damage.
 
  The fourth element that must be present is: a. The nurse caused more than 50 of the damage.
