If, as Durkheim suggests, that deviance is inevitable, then one way to measure whether we live in a good society is to examine how the society treats its deviants. This treatment includes how we protect people from deviant behaviors that are harmful to themselves and others, how we tolerate deviance that is not harmful, and how we establish fairer systems of treatment for deviants. Based on how the U.S. treats people who are deviant, we can conclude that the United States needs to develop a more humane way of treating people who do not conform to the norms of the society. This is evident by a review of the spiraling prison population, the use of the death penalty, biased reactions to crime by the police and courts, and how people who engage in deviant, but harmless, behaviors are treated by society.
