Express contracts are contracts where the terms of the contract promise are explicit and summarized in either a written or an oral agreement. Implied contacts occur when the court system concludes that a contract exists based on an interpretation of the activities surrounding the circumstances that occurred that indicate that the parties involved intended for there to be a contract.
