Answer to Question 1

According to the Taft-Hartley Act states are allowed to determine whether they will enact right to work laws that prevent projects from being completely union shop. Union shop is legal if non-union workers are not prevented from being hired and they are allowed thirty days to join a union.

Answer to Question 2

When a safety violation at a construction job site is discovered by an inspector for the Occupational Health and Safety Administration they attempt to enforce safety by issuing a citation that describes the violation and a penalty and that provides a time frame in which the violation needs to be corrected by the employer. The violation citation has to be posted close to where the violation occurred at the job site. Employers have fifteen days in which to contest a violation and to have a review commission hold a formal hearing. Citations are enforced through the United States Court of Appeals.
