Answer to Question 1

The bankruptcy code accomplishes this by authorizing the bankruptcy court's supervision and administration of the bankruptcy case as well as providing creditors with the opportunity to participate in the process. Creditors are also afforded fair treatment in the settlement and distribution of the debtor's assets and are protected when debtors with sufficient income are required to pay their debts instead of having them totally discharged.
