This type of examination is held before a judge to determine whether or not there is enough evidence to hold a defendant for trial. The prosecution presents evidence in the form of oral and physical evidence. Examination transpires much like a regular trial. The defendant may or may not present any evidence. The results of a preliminary hearing are a holding order which binds the defendant over for trial court or n acquittal.
