Felix and Oscar are street racing their cars on a public road. A crowd of children has gathered to watch the race. Oscar, driving at a high speed, loses control of his car and plows into the gathering of children. Susie is run over; five days later, Susie dies of her injuries while being treated in the hospital. Has Oscar committed the tort of wrongful death? Why or why not? If so, who can bring that action (since Susie is dead)?

Answer to Question 1

Oscar has committed the tort of wrongful death because his tortious conduct resulted in the death of his victim (Susie). Susie's legal representatives (probably her parents) could bring the action on behalf of Susie's estate.
