Attorney Jack Parsons has lost an important lawsuit, and all appeals were exhausted. The client e-mails are an important written record of communication between the firm and the client. If there were a claim for malpractice against the law firm, the e-mails could provide evidence in the firm's defense. When lawyers are forced to defend themselves against such claims, any confidentiality or privilege with respect to these communications may be released so that the attorneys can use it in their defense.
