What potential ethical problems could result from recording time spent on a case on the outside of a client's file folder? How can these problems be avoided?

While inputting time records, a paralegal sees that the same law firm employee is billing two clients for the same time on the same task (double billing). What are the ethical obligations of the paralegal? Are there any ethical issues that the paralegal or law firm may face if the double billing is not corrected?

Information written on the outside of the client folder can be seen by anyone. Time or record keeping contains confidential or privileged information, and the legal team will have breached it ethical obligation to protect the client's information.

Answer to Question 2

The paralegal has an obligation to the law firm and its clients to be sure that accurate billing is prepared. The paralegal can ask the person who recorded the time if it might have been an error. If no error, the paralegal should determine if there should be a correction. If dissatisfied with the response or not comfortable asking the other staff member, the paralegal should bring the matter to the attention of the managing or supervising attorney for investigation.
