Answer to Question 1

The opinions in the Zubulake case provide extensive guidance on e-discovery. They are still widely read on these issues. The team should also look at the amendments to the Federal Rules and the cases that interpret them.

Answer to Question 2

The 2006 Amendments were enacted to address three specific concerns: (1) preservation of electronic materials; (2) production of electronic materials, and (3) destruction of electronic materials. Rule 16 governs pretrial conferences, case scheduling and management. Rule 26 provides general provisions concerning discovery and the duty to disclose.
