The USPTO may deny the application of a trademark is too generic, if the mark is not used is commerce, or if the mark is already in registered to another owner.

Answer to Question 2

Courts can issue a temporary restraining order (TRO), temporary injunction, or a permanent injunction. The Lanham Act also allows the plaintiff to recover money damages for:
(1) the defendant's profits, (2) any damages sustained by the plaintiff, and (3) the costs of
the action, including attorney's fees. The Lanham Act also allows for enhanced statutory
damages for willful infringement.
