Question 2

On August 30, George mails John an offer on his boat, which requires a written acceptance. On September 1, John receives the offer and immediately calls George and tells him, We have a deal Put it in writing, George replied. John writes out a letter the next day accepting George's offer, but doesn't mail it until September 4. George receives the letter on September 6. When was the contract formed? Explain your answer.

Answer to Question 2

The contract was formed on September 4. Under the mirror image rule, John could not orally accept George's offer - he had to send the letter. Under the mailbox rule, the mailing of the letter was the effective date of acceptance, and therefore the contract was formed when John's letter was mailed on September 4.
