Because it interprets the meaning of the Constitution, which is the supreme law of the land, the U.S. Supreme Court has been extremely important in shaping criminal justice policy. The liberal Warren Court expanded civil rights and the rights of defendants. The moderate Burger Court did not create the expected conservative counter-revolution. The Rehnquist Court was generally conservative, but issued a number of liberal decisions. And, based on the small number of cases decided thus far, the Roberts Court appears to be more conservative than the Rehnquist Court with Justice Kennedy now casting the swing vote.
