Answer to Question 1

The four types of charging documents include a complaint, an information, an arrest warrant, and an indictment. Complaints must be supported by oath or affirmation by an officer or a victim and are generally used for misdemeanors and ordinance violations. An information is similar to a complaint, except that it is signed by the prosecutor. The filing of an information is required in states that do not use grand juries. In states with grand juries, the document is used to initiate the grand jury investigation. The third type of charging document is the arrest warrant, which is issued by a judge, usually for street crimes. An indictment represents a fourth type of charging document. An indictment is a finding of probable cause by the grand jury, which means that the trial will commence for the defendant.
