The equal justice perspective asserts that all people should receive the same treatment under the law; the criminal justice system must reduce discretion and unequal treatment. The treatment of criminal offenders must be based solely on present behavior; punishment must be equitably administered and based on what people deserve for their crimes (just desserts). Efforts to distinguish between criminal offenders and create a system of individualized treatment creates a sense of unfairness that undermines the goals of the system, which can result in anger and a sense of unfairness that will increase the likelihood of recidivism.
