The majority of studies fail to find that the death penalty deters. New studies, however, argue that the relationships between the death penalty and deterrence have been masked by faulty research methods. The newer studies use more sophisticated analysis and find a more significant association. This is especially prevalent if executions are used more often. This would be predicted by deterrence theory because using the death penalty more often increases the perceived certainty of being executed.
