Custody is defined for Miranda purposes as when the suspect is under arrest or
deprived of freedom in a significant way. Two examples of interrogation situations
where custody would exist are: (1) when Officer Smith tells Z You are under
arrest. and (2) when Officer Jones handcuffs X and places X in the back of a
patrol car. Two examples of interrogation situations where custody would not exist
are: (1) when Officer Stone approaches J and begins asking him about the shooting
and (2) when Officer Rock begins asking questions of K in K's apartment kitchen
about the assault.
