Answer to Question 1

Provisions of state constitutions as they apply to criminal cases must be consistent
with the provisions of the federal Constitution or they may be declared
unconstitutional if challenged in court. More detailed than the U.S. Constitution,
state constitutions frequently offer greater protections to the individual.

Answer to Question 2

The motion for a change of venue is usually filed by the defendant. The decision of a
trial judge to grant or deny the motion is seldom reversed on appeal.
