Answer to Question 1

If contraband is inadvertently discovered by a private party and law enforcement is notified, responding officers could recreate or have the private party recreate the search that led to the discovery and seize the contraband. Officers cannot ask the private party to find additional evidence. It is not uncommon, for example, for citizens to take their computers to a technician for repair. If contraband is inadvertently discovered during that repair and the technician notifies law enforcement, responding officers could recreate or have the technician recreate the search that led to the discovery and seize the contraband. However, the officers cannot ask the repair technician to find additional evidence. Making such a request is analogous to deputizing the technician and making him or her an agent of the government.
