In the context of residential tenancies, a tenant's failure to pay rent can lead to an application by the landlord to a residential tribunal requesting that the back rent be paid or the tenant be evicted. Additionally, with respect to the tenant's property in the rental unit, the landlord may:
◦ seize and sell any of the tenant's property for failure to pay rent.
◦ do absolutely nothing as far as seizing and selling the tenant's property is concerned, given that the remedy of distress in the residential context has been abolished.
◦ change the locks on the rental unit and arrange for public auction on notice to all interested parties including the tenant.
◦ seize the tenant's property for failure to pay rent but not sell it, providing the tenant with a period of time to come up with the back rent.
◦ offer the tenant's property to a new tenant but only if any sale proceeds are turned over to the defaulting tenant.
