The EEOC's position makes sense. It is built on the language of Congress reassignment to a vacant position and it applies only after other accommodations have failed; and the reassignment to a vacant position only takes place if the disabled employee is qualified and it is not an undue burden on the employer. Surely if the job can not get done right, the employer has an out under the EEOC guidance.
