Does Section 702 of Title VII allow religious societies to hire co-religionists for secular activities as opposed to religious activities?

Answer to Question 1

The 1972 amendments to Section 702 allow religious societies to hire co-religionists without regard for whether the particular activity of the society is secular or religious. However, Judge Mazzone wanted to steer clear of the constitutional arguments and found narrowly that the Monitor news-paper was a religious activity, as opposed to a secular activity, of the religious organization the Christian Science church.
