Answer to Question 1

Yes. Nothing in the Griggs decision or the Act precludes the use of testing or measuring procedures. The Court says that obviously the procedures are useful. They must, however, demonstrably be pertinent as a reasonable measure of job performance. Congress has not commanded that the less qualified be preferred over the better qualified simply because of minority origins but rather that any test used measure the person for the job and not the person in the abstract.
