Informed consent means that the patient understands the reason for the proposed intervention, and its benefits and risks, and agrees to the treatment by signing a consent form. Consent forms must be obtained for all invasive procedures. Legally, the patient must be mentally competent to give consent for medical procedures. The signing of an informed consent can also be waived for urgent medical and surgical intervention as long as institutional policy so indicates.

The ANA's Code for Nurses (1985) states that the nurse acts to safeguard the patient and the public when health care and safety are affected by incompetent, unethical, or illegal practice of any person. Nurses are obligated to follow the orders of a licensed physician or other designated health care provider unless the orders would result in patient harm.
