If an owner orders work removed in order to conduct an inspection who is responsible for the cost of replacing the work and why?

Answer to Question 1

If an inspection clause is included that resembles the following and an owner orders work to be removed to conduct an inspection then the contractor is responsible for replacing defective work: A clause that allows the owner's representative to order work to be removed to inspect work that has been covered up by the work with no recourse for the contractor, and at the expense of the contractor, for replacing the work.

Answer to Question 2

Inspectors are responsible for ensuring that the work is performed in accordance with the contract documents but it needs to be realized that if the contract is incorrect it is not the responsibility of the inspector to change it, as they are not empowered to do this during construction. Inspectors are only allowed to assist the engineer as the engineer corrects the situation by issuing revisions, extras, or adjustments to correct the contract requirements.
