Duncan is injured and his car is damaged. In determining whether Billy breached a duty of care owed to Duncan, what standard of care is applied (in other words, what is the test used to determine if Billy breached a duty of care)? The standard used to determine breach of the duty of care is the reasonable person standard. The reasonable person standard is the standard of behavior expected of a hypothetical reasonable person under the same or similar circumstances.
