Question 2

Billy is driving home from work, texting his girlfriend about when and where to meet him for dinner. Driving distractedly, Billy rams into a car driven by Duncan. Duncan is injured and his car is damaged. In determining whether Billy breached a duty of care owed to Duncan, what standard of care is applied (in other words, what is the test used to determine if Billy breached a duty of care)? Identify and define that standard.

The standard used to determine breach of the duty of care is the reasonable person standard. The reasonable person standard is the standard of behavior expected of a hypothetical reasonable person under the same or similar circumstances.
