The majority of searches are conducted without a warrant under one of the recognized exceptions to the warrant requirement. Exceptions to the warrant requirement include: searches
incident to lawful arrest; motor vehicle searches; consent searches; border searches; searches of open fields; plain view; special needs searches in public schools; searches of public employers and/or their work-spaces; administrative searches; abandoned property; aerial searches; searches of people under correctional supervision; and third party disclosure. Given the large number of exceptions to the warrant requirement it is not surprising that most searches are conducted without a warrant. Additionally, these exceptions come as a result of cases which are challenged based on the behavior of law enforcement officers in the field. It is therefore reasonable to conclude that the exceptions come from the behaviors that law enforcement officers are likely to participate in on a regular basis. Therefore, they are the most common searches.
