The majority of searches are conducted without a warrant under one of the recognized exceptions to the warrant requirement. Exceptions to the warrant requirement include: searches
incident to lawful arrest; motor vehicle searches; consent searches; border searches; searches of open fields; plain view; special needs searches in public schools; searches of public employers and/or their work-spaces; administrative searches; abandoned property; aerial searches; searches of people under correctional supervision; and third party disclosure. Given the large number of exceptions to the warrant requirement it is not surprising that most searches are conducted without a warrant. Additionally, these exceptions come as a result of cases which are challenged based on the behavior of law enforcement officers in the field.
