Answer to Question 1

The advantages of obtaining a warrant in search and seizure cases are that a
magistrate has determined probable cause and any evidence found is more likely to
be admissible. A disadvantage is that obtaining a warrant takes time and may be
denied by the magistrate. Having a search warrant also decreases an officer's
liability.

Answer to Question 2

The three ways whereby probable cause is established are: (1) through an officer's
own knowledge of particular facts and circumstances, (2) through information given
by a reliable third person, and (3) through information plus corroboration by the
officer. They differ in that the third way is the most reliable because it has the
greatest amount of information from more than one source. The second way
depends on the reliability of the third person.
