Provide a summary of an actual case that is an example of or relates to either a direct appeal or discretionary appeal. Summarize the case and state why it falls into the aforementioned types of appeal.

Answer: A good answer will vary with the case example, but should include the definition of either a direct appeal or a discretionary appeal and an explanation of why that case fits into that category.

Answer to Question 2

Answer: Good answers should explain the many factors which judges examine when deciding an appropriate sentence. Students should also explain victim impact statements and why they are used.
