Law enforcement actions that do not require a warrant include searches incident to arrest,
searches based on exigent circumstances, automobile searches, plain view searches, arrests based on exigent circumstances, arrests in public places, and consent.

Answer to Question 2

It would be impractical, and sometimes even dangerous, to wait for a warrant before conducting much of police business. An example would be search incident to arrest. An officer needs to have the empowerment to search the suspect and the immediate area for safety purposes only.
