Answer to Question 1

The adversarial model of justice involves both sides of a dispute having their day in
court. Both sides are permitted to present their evidence to the court, resulting in two
opposing sides to a single story. The inquisitorial model of justice, in contrast, involves
the court appointing a neutral investigator to collect evidence from both sides of a
dispute and then that investigator presents his or her findings to the court. Research
shows that regardless of the verdict, both sides of a dispute are more satisfied when
they are part of an adversarial trial as opposed to an inquisitorial one. Further research
suggests that it is not inherently the adversarial process, but that the adversarial
process allows one to give voice to their understanding of an issue, that is the key
feature resulting in higher satisfaction levels.
