Yes. The court speculated that suppose on-call time constituted work, then the hospital would be likely to modify its practices. It would abolish the on-call system and have EMTs on the premises 24 hours a day, hiring additional EMTs to avoid paying premium pay. The hospital would pay more and the EMTs, like the plaintiffs, would earn less.
