The jury found that the reassignment was not gender discrimination in violation of Title VII and that matter was not appealed. The Supreme Court held that the jury could reasonably conclude that the reassignment from forklift operator to track laborer duties would have been materially adverse to a reasonable employee, thus constituting retaliatory discrimination.
