Answer to Question 1

Under Section 8(f) of the Act employees may challenge a prehire agreement at any time by petitioning for a representation election, or they may petition for a decertification election. Thus, employees have an out from this arrangement, if it is the wish of a majority of the employees.

Answer to Question 2

If a non-certified union is picketing an employer, the picketed employer may file an election petition, which requires the Board to conduct an expedited election. If a majority of the employees do not then support the union, the union is barred from picketing for 12 months. In the construction industry, a job may well be substantially completed in that 12-month period.
