Wilson Coleman owned 45 acres of residential property that he had intended to develop as a large-lot residential area. However, when the real estate market took a down-turn, Mr. Coleman filed a Request for Rezoning with the City of Tupelo's Department of Planning and Community Development to have his property rezoned from large-lot residential to a planned unit development (PUD) consisting of single-family homes and a retirement community. The Planning Department reviewed the request and issued a report recommending that Coleman's request for rezoning be approved. The City Council held a public hearing regarding the rezoning request. Thomas Gardner appeared at the hearing and opposed the rezoning. However, the City Council voted to approve Coleman's request. Discuss whether the City Council acted properly in taking the action.

Answer to Question 1

The City Council needs to establish that it heard sufficient evidence to support its change in the use of the land as a public need. Although neighbors may not like the changes that are being made, if there is a need for such housing in Tupelo and that need is not being satisfied, the City Council can vote to make the changes. Zoning authorities are given great deference by the courts.
