Wilson Coleman owned 45 acres of residential property that he had intended to develop as a large-lot residential area. The Planning Department reviewed the request and issued a report recommending that Coleman's request for rezoning be approved. The City Council held a public hearing regarding the rezoning request. Thomas Gardner appeared at the hearing and opposed the rezoning. However, the City Council voted to approve Coleman's request. Discuss whether the City Council acted properly in taking the action.

The City Council needs to establish that it heard sufficient evidence to support its change in the use of the land as a public need. Although neighbors may not like the changes that are being made, if there is a need for such housing in Tupelo and that need is not being satisfied, the City Council can vote to make the changes. Zoning authorities are given great deference by the courts.
