Anyone providing health care services as a covered entity is required to comply with the U.S.
 
  Department of Health and Human Services (HHS) regulations concerning privacy and confidentiality under the Health Insurance Portability and Accountability Act (HIPAA), implemented in 2003 . Mental health facilities are considered to be covered entities if they: a. employ less than five service providers
  b. exchange billing or insurance eligibility data by electronic means
  c. provide care on a fee for service basis
  d. make and record psychiatric diagnoses according to the DSM-IV
