The Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM Act) is a federal law establishing civil a 1,000 electronic mail messages during a 30-day period, or more than 10,000 electronic mail messages during a one-year period. The CAN-SPAM Act applies to multiple emails defined as more than 100 electronic mail messages during a 24-hour period, more than ission (FTC) enforce the CAN-SPAM Act. A person found guilty for violations of the CAN-SPAM Act can receive a maximum sentence to up to five years in prison, a fine, or both imprisonment and a fine. The criminal provisions of CAN-SPAM are for the most egregious violations and prohibit sexually explicit email that fails to include a label designating it as sexually explicit.
