Mary signed a one-year lease in a local apartment complex. Mary continued to stay in her apartment without renewing the lease. Mary continues to pay the rent each month and the landlord continues to accept it. Explain what type of leasehold possessed by Mary.

Answer to Question 1

This is a tenancy by sufferance. It is created when Mary retains possession after the end of one year lease period. In this case, tenancy by sufferance exists because Mary had an original right to possess the leasehold, that right has ended, and Mary remains in possession without the agreement of the landlord, although the landlord continues to accept the rent.
