This is a tenancy by sufferance. It is created when Mary retains possession after the end of one year lease period. In this case, tenancy by sufferance exists because Mary had an original right to possess the leasehold, that right has ended, and Mary remains in possession without the agreement of the landlord, although the landlord continues to accept the rent.
