In Richardson v. McKnight, the Supreme Court held that correctional officers employed by a private firm are not entitled to qualified immunity from suits filed by prisoners. In Correctional Services Corp v. Malesko, the Supreme Court ruled that although a prisoner can sue an employee of the private correctional corporation for violating his constitutional rights, he could not sue the correctional corporation itself.
