Answer: Conviction rates for indigent defendants and those with their own lawyers were about the same in
Federal and States courts. About 90 percent of the Federal defendants and 75 percent of the defendants
in the most populous counties were found guilty regardless of the type of their attorneys.

Answer to Question 2

Answer: The U.S. Supreme Court has held that in certain instances an accused must be provided with an
attorney, even if he or she cannot afford one. Even in minor cases, Argersinger v. Hamlin, for example
where the U.S. Supreme Court held that no person may be imprisoned for any offense without the
assistance if counsel.
