Answer to Question 1

Children may fail to appreciate the consequences of their testimony and the importance of complete and total disclosure and veracity, or accuracy, regarding their statements. In addition to evaluating the ability of the child to understand the need for truth, the trial judge will also consider the individual's ability to remember and recount the events in question. Criteria to evaluate the admissibility of a child witness will vary.
