It is permissible to search somebody and their immediate surroundings incident to a lawful arrest. The search must be contemporaneous to the arrest and the defendant must be present. Handheld devices found incident to a lawful arrest should be removed with care and properly preserved. It is acceptable to search pagers, but the case law regarding other handheld devices is in its infancy. If unsure, the best course of action is to seize, preserve, and obtain a warrant to search.
