If John and Jane are at a party and they have both been drinking alcohol, and John initiates sexual activity with her, Jane can legally give full consent only if/when:
 
  a. she gave consent prior to consuming the alcohol.
  b. she is no longer physiologically affected by the alcohol she consumed.
  c. she had sex with him on a previous occasion and gave consent then.
